Please refer to Federal Rule of Bankruptcy Procedure 8009 and 8010 for guidance on preparing, completing, and transmitting the record on appeal.
- When requesting a transcript for purposes of preparing the record for an appeal, the appellant must follow the court’s transcript request process and must note on the Audio Recording/Transcript Order form that the transcript is being requested for an appeal.
- A transcriber selected to transcribe the recording for an appeal to the district court, the Bankruptcy Appellate Panel (BAP), or the Eighth Circuit Court of Appeals must:
- File an acknowledgment showing when the order was received and when the reporter expects to have the transcript completed. The transcriber must use the Transcriber’s Acknowledgment of Transcript Order event in CM/ECF.
Note: For consistency, we require the transcriber to acknowledge a transcript order on all transcript orders, including those that are not being requested for an appeal, by using the Transcriber’s Acknowledgment of Transcript Order event in CM/ECF.
- After completing the transcript, the transcriber must file the transcript with the bankruptcy clerk, using the Transcript event in CM/ECF. The bankruptcy clerk will notify the district, BAP, or circuit clerk of its filing.
- If the transcriber cannot compete the transcript within 30 days after the order has been received, the reporter must request an extension from the bankruptcy clerk. The request must be submitted using the Transcriber Request for Extension of Time to File Transcript event in CM/ECF. The bankruptcy clerk will enter on the docket and notify the transcriber whether the request for an extension is granted.
- File an acknowledgment showing when the order was received and when the reporter expects to have the transcript completed. The transcriber must use the Transcriber’s Acknowledgment of Transcript Order event in CM/ECF.
- If the appellant, or cross-appellant, will not order a transcript for an appeal, the appellant or cross-appellant must file a certification stating such using the Certification of Appellant or Cross-Appellant No Transcript Will Be Ordered event in CM/ECF.
