Chapter 13 Case Processing Updates

The Minnesota Bankruptcy Clerk’s Office moved to automatic 341 Noticing for 2026 calendars. As part of this change, 341 Notices will continue to provide the Chapter 13 Confirmation Hearing date and time. This CM/ECF automation requires that all confirmation hearings be set for the same time, 10:00 a.m. Because this change was implemented after some cases already received a 2026 hearing date, there will be some cases on the January and February calendars which still display a 10:30 a.m. hearing time. Moving forward, the 10:30 a.m. hearing option will no longer be available for scheduling purposes and filers should ensure that all newly filed documentation matches the hearing time selected which will be 10:00 a.m.

The Clerk’s Office also wants to take this opportunity to remind Chapter 13 filers of the following:

  • Use the Agreed Continuance of Chapter 13 Confirmation Hearing event when a filer wants to continue the confirmation hearing for a plan, a modified plan, or a motion to modify a confirmed plan to the next Chapter 13 calendar.
  • Use the Agreed Continuance of Chapter 13 Motion to Dismiss event when a filer wants to continue a Motion to Dismiss to the next Chapter 13 calendar.
  • File a separate Agreed Continuance event for each hearing entry. For example, if the intent is to continue the confirmation hearing and a motion to dismiss, you must file two separate Agreed Continuances using the two separate events. Failure to file an event for each hearing entry may result in orders being entered for the non-continued hearing.
  • When filing a Motion to Dismiss, you must relate the motion to the applicable Confirmation Hearing. Do not relate a Motion to Dismiss to an Agreed Continuance of Chapter 13 Confirmation Hearing event as doing so will cause the case to appear on the on the calendar for a Confirmation Hearing twice.
