Orders on Partial Case Filing

Overview:

If your initial filing is incomplete, you will receive an Order on Partial Case Filing identifying the document or documents missing.

Contents:

  1. The Order will identify what documents are missing
  2. The Order MAY provide additional details or explanations
  3. The Order will provide a deadline for filing the missing documents
  4. Failure to file the missing documents may result in dismissal of your case

1.  The Order will identify what documents are missing

A portion of a sample Order on Partial Case Filing appears below in Figure 1, showing that the Payment Advices Cover Sheet and Debtor’s Income Records were missing from the original filing:

2.  The Order MAY provide additional details or explanations

Sometimes, the clerk’s office will include in the Order additional details or an explanation of why a filing was incomplete. This information will appear in the “Details” section of the Order, beneath the checklist of documents required for a complete filing.

Please pay close attention to any information in the “Details” section of the Order.

3.  The Order will provide a deadline for filing the missing documents
 

Paragraph 1 of the Order will provide a deadline for filing the missing documents.  The deadline is typically fourteen (14) days after the date your case was filed.  The missing documents MUST BE FILED with the Clerk’s Office ON or BEFORE that deadline.

4.  Failure to file the missing documents may result in dismissal of your case

If the documents identified as missing in the Order on Partial Case are not filed by the deadline, your case may be dismissed.  

If you do not understand the Order, please call the clerk’s office for clarification.  

If you need additional time to file the required documents, you must file a written request for an extension of time before the expiration of the deadline in the Order on Partial Filing.  Clerk’s office employees are not authorized to grant extensions of time; only a judge may grant or deny your request for an extension of time to file documents.
