District of Minnesota will opt out of use of National Chapter 13 Plan Form

The Judges of the United States Bankruptcy Court for the District of Minnesota have determined the court will opt out and not use the proposed national chapter 13 plan form approved by the Judicial Conference of the United States. The Bankruptcy Practice Committee is currently working on revisions to the current chapter 13 plan form, Local Form 3015-1, to ensure it conforms to the requirements of pending Federal Rule of Bankruptcy Procedure 3015.1. This Rule allows courts to opt out of use of the national plan form if the local plan forms meets certain criteria. The draft revised chapter 13 plan form will be posted for notice and comment by the bar in August or September, and once approved, will take effect on December 1, 2017.
