12/1/15 Form Changes Revisited

We now have six days experience with the new forms.  Some attorneys are confused about which forms to use, so the following attempts to clarify the court’s requirements: 

  • Use of the new official bankruptcy forms is REQUIRED for new cases and for amendments and conversions of cases filed before December 1, 2015.  See 12/1/15 Forms Resource Page, Filing Requirements for new cases and conversions.  
  • Amended schedules must be accompanied by an amended Summary of Assets and Liabilities (Form 106 Summary or 206 Summary).  The filer should check the “amended” box in the upper right hand corner of the first page of each amended form.  

In addition to the national form changes, filings should include the following updated local forms

Disclosure of Compensation of Attorney for Debtor form (Local Form 1007-1)(revised 12/15)

An order on partial case filing will be issues in cases filed using the outdated Local Form 1007-1.

Notice of Responsibilities of chapter 7 debtors and their attorneys (Local Form 1007-3-1(7)*

OR

Notice of Responsibilities of chapter 13 debtors and their attorneys (Local Form 1007-3-1(13)*

Amended to change references from "Debtor" and "Joint Debtor" to "Debtor 1" and "Debtor 2," to conform to the language of the new official forms.

*Attorneys should use the 12/15 versions of the Signature Declaration, Payment Advices Cover Sheet and applicable Notice of Responsibilities.  However, NO order on partial case filing will be issued if outdated versions of these forms are used.

The court sent multiple “blast email” notices about the national form changes, local rule and form changes, the creation of and additions to the 12/1/15 Official Bankruptcy Forms Resource Page, and recent updates to the formatting of the official and unofficial local forms.  These same notices are also posted under the News and Announcements section on the homepage of the court’s website.  Attorneys or their staff members who are not receiving these messages may wish to subscribe or update their subscription to the court’s blast email service, GovDelivery.
