Law Firm Change Procedures


Revised CM/ECF Procedures for Attorney Leaving Law Firm

REMINDER: If you are changing law firms, you may need to clear your default PACER login to prevent your previous law firm from incurring charges for searches done at your new law firm. To clear your PACER login, click the "Clear Default PACER Login" button under the "Utilities" menu.

The Court has instituted the following revised guidelines when an attorney leaves a firm.

Attorney leaving the firm

An attorney leaving a firm can make changes to his/her account such as a change in address, telephone number and email address in CM/ECF under the Utilities screen and Request Account Modification.
If the attorney does not intend to continue practicing in the bankruptcy court, he/she should contact Woody Parks at 612-664-5236. Woody will deactivate the attorney's password.
If the attorney intends to continue practicing in the bankruptcy court, the firm the attorney is leaving needs to file a Notice of Withdrawal and Substitution of Counsel found at Bankruptcy, Post Petition Events, Other Case Events for the departing attorney's cases as soon as possible. Court staff will transfer these cases to the new counsel for the firm before the leaving attorney begins filing with the new firm.



If the Leaving Attorney is a Debtor's Attorney

-This procedure applies to attorneys who represent debtors
The firm the debtor's attorney is leaving should file a Withdrawal and Substitution of Attorney Form (for use by attorneys who represent only debtors) in PDF to the CM/ECF inbox which can be found at Bankruptcy, Post Petition Events. Select one case number for the inbox.
If the firm is retaining all the departing attorney's cases a list of cases and case names is not required.
If the firm is retaining only some of the cases, the firm must list the case number and debtor name for each retained case on the form. Both the departing and the newly assigned attorney must sign this form. (See Rule 9011-4(f) regarding multiple signatures.)
If the Leaving Attorney is NOT a Debtor's Attorney
The firm the attorney is leaving should file a Withdrawal and Substitution of Attorney Form to each case retained, identifying the attorney in the firm to whom future notices should be sent.
